Agreement:

Before the Special Master may be appointed, both parties must stipulate to the appointment and use of a Special Master. Once a Special Master has been agreed upon, counsel for the parties will coordinate with the parties and the Special Master regarding preparation, execution, and filing of the Special Master Order to be filed with the Court. The Special Master Order governs the scope of the Special Master’s authority pursuant to Rule 53A of the Utah Rules of Civil Procedure.

Process:

After the Special Master Order has been signed and filed with the Court, our office will send an introductory letter to all parties and counsel outlining procedures, communication guidelines, and billing information. At that time, our office will also collect the required retainer, as outlined in the Special Master Order, and schedule separate initial Zoom appointments with each party. These initial meetings provide the parties with an opportunity to ask questions and allow the Special Master to explain the process and expectations moving forward.
